# PSDP vs PSCS: Understanding the Difference and When You Need Both --- The roles of Project Supervisor for the Design Process (PSDP) and Project Supervisor for the Construction Stage (PSCS) are among the most frequently misunderstood requirements in Irish construction law. Clients, contractors, and even some safety professionals are uncertain about the difference between the two roles, when each must be appointed, and whether the same person or organisation can fulfil both. This article provides a clear, practical explanation of the PSDP and PSCS roles, their respective duties, the circumstances in which both must be appointed, and the consequences of failing to make the required appointments. --- ## The Legal Basis Both roles are created by the Safety, Health and Welfare at Work (Construction) Regulations 2013 (S.I. No. 291 of 2013). The Regulations implement the EU Temporary or Mobile Construction Sites Directive (92/57/EEC) in Ireland and apply to all construction work as defined in the Regulations. The appointment obligations arise when a construction project meets the notification threshold, which is when: - The construction phase is likely to last longer than 30 working days and have more than 20 workers simultaneously on site, or - The volume of work is likely to exceed 500 person-days, or - The work involves particular risks listed in Schedule 1 of the Regulations (which includes excavations deeper than 5 metres, work near high-voltage power lines, and demolition work, among others) Where the notification threshold is met, the client must appoint both a PSDP and a PSCS before work begins. --- ## The PSDP: Project Supervisor for the Design Process The PSDP is responsible for co-ordinating health and safety during the design stage of the project. The PSDP's role begins at the outset of the design process and continues until the construction phase begins, at which point the PSCS takes over the primary co-ordination role. ### Who Can Be Appointed as PSDP? The PSDP must be a competent person or organisation with knowledge and experience of health and safety in construction. In practice, the PSDP is often the lead designer (architect, engineer, or design and build contractor), but it can also be a specialist safety consultant appointed specifically to fulfil the role. The client appoints the PSDP. Where the client is a domestic householder (rather than a business), the obligation to appoint a PSDP still applies if the project meets the notification threshold. ### The PSDP's Key Duties The PSDP's duties under the Construction Regulations 2013 include: **Notifying the HSA.** The PSDP is responsible for submitting the AF1 Advance Notification form to the HSA before the construction phase begins. The notification must be submitted as soon as practicable and must be displayed on site throughout the construction phase. **Preparing the Preliminary Health and Safety Plan.** The PSDP must prepare a Preliminary Health and Safety Plan that identifies the hazards and risks associated with the project as identified during the design stage. The Plan must be provided to the PSCS before the construction phase begins and must be taken into account by the PSCS in preparing the Construction Phase Safety and Health Plan. **Co-ordinating design for safety.** The PSDP must co-ordinate the work of the designers to ensure that health and safety considerations are integrated into the design. This includes ensuring that designers identify and eliminate hazards where possible, and that residual hazards are communicated to the PSCS and recorded in the Safety File. **Preparing the Safety File.** The PSDP is responsible for preparing and maintaining the Safety File, which is a record of information relevant to the health and safety of the structure during its future use, maintenance, and eventual demolition. The Safety File must be handed over to the client on completion of the project. --- ## The PSCS: Project Supervisor for the Construction Stage The PSCS is responsible for co-ordinating health and safety during the construction phase of the project. The PSCS's role begins when the construction phase starts and continues until the project is complete. ### Who Can Be Appointed as PSCS? The PSCS must be a competent person or organisation with knowledge and experience of health and safety in construction. In practice, the PSCS is almost always the main contractor on the project, although it can be a specialist safety consultant where the client wishes to separate the safety co-ordination role from the construction management role. The client appoints the PSCS. The PSCS must be appointed before the construction phase begins. ### The PSCS's Key Duties The PSCS's duties under the Construction Regulations 2013 include: **Preparing the Construction Phase Safety and Health Plan.** The PSCS must prepare a Construction Phase Safety and Health Plan before the construction phase begins. The Plan must be based on the Preliminary Health and Safety Plan provided by the PSDP and must address the specific hazards and risks on the project. **Co-ordinating health and safety on site.** The PSCS is responsible for co-ordinating the health and safety activities of all contractors working on the site, including ensuring that they comply with the Construction Phase Safety and Health Plan and with all relevant health and safety legislation. **Managing subcontractors.** The PSCS must ensure that all subcontractors are competent and that they have adequate resources for health and safety. Yes, the same person or organisation can be appointed as both PSDP and PSCS, provided they are competent to fulfil both roles. However, there are circumstances in which it is not appropriate for the same person to fulfil both roles. Where the design and construction are carried out by different organisations, the PSDP and PSCS will typically be different persons. Where the client wishes to maintain an independent check on health and safety, they may appoint a specialist safety consultant as PSDP and the main contractor as PSCS. --- ## What Happens If the PSDP or PSCS Is Not Appointed? Failure to appoint a PSDP or PSCS where required is a breach of the Construction Regulations 2013 and can result in: - Prosecution of the client by the HSA - Issuance of an improvement notice or prohibition notice - Civil liability if a worker is injured as a result of the failure to appoint The client cannot avoid the obligation to appoint by claiming ignorance of the requirement.
